In the abortion case, decided today, 5–4, with Roberts in the majority, allowing women access to facilities for that purpose, they set aside a restrictive Louisiana law that would have left the state with only one abortion clinic.

Today’s decision was based on an earlier Texas decision where Roberts dissented. The class of his judicial demeanor was to follow the decision he disapproved originally. Roberts said he continues to “believe that the [Texas] case was wrongly decided.” But he said the question was whether to “adhere to it in the present case.” And he did.

On the other hand, Kavanagh said during his hotly contested Judiciary Committee hearings that he’d follow settled law but then he dissented in this case — though it is settled law — because he’s an alt right federalist ideologue — and no one should ever have been trusted him to do what he said he would do.

Senator Collins, you made this Kavanaugh dissent possible, when you were persuaded (by the WH no doubt) to approve his nomination.
