The Sentencing Table that the Court referenced in making her decision, places Stone in criminal history category I — no prior history.
The base offense level within that criminal history category for obstruction of justice is 14 (for a range of 15–21 months)(1).
But the upward adjustments for — a. obstruction (8 levels), b. for interfering with the administration of justice (3 levels), c. for the offense being extensive (2 levels), and d. for obstructing the current prosecution (2 levels), bringing the total to an offense level of 29 (for a range of 87–108 months) (3)
The judge shaved about 9 levels to consider the range of 33–41 months, sentencing Stone to 40 months in custody. (2).
